Approval from City of Sydney to (respectfully) push the envelope
Delighted for my clients who have been waiting patiently for the determination of this application that exceeds the current height control by 20%, similar to a large proportion of earlier development within the Heritage Conservation Area.
Reasons for Approval
1. The development, subject to conditions, is consistent with the objectives of the R1 – General Residential zone;
2. Based on the material provided at determination, the consent authority is satisfied that the applicant has adequately addressed the matters required to be addressed in Clause 4.6 of the Sydney Local Environmental Plan 2012. The consent authority is satisfied that it is reasonable to vary the height development standard in this instance and that there are sufficient environmental planning grounds to contravene the standard;
3. The design of the addition responds appropriately to the scale of surrounding buildings and its siting is respectful of the contributory building;
4. The development is compatible with the character of the .. Heritage Conservation Area;
5. The development will not unreasonably compromise the amenity of nearby properties; and
6. The development accords with objectives of relevant planning controls, and is considered to be in the public interest.
